Application for the acquisition or concession of provincial or State property under the management of the property management and logistics service. Excluded are: water, forestry, roads.

Description

The citizen or company that intends to acquire or only use a state property (or non-transferable heritage) no longer functional for the Administration may submit a request to the Property and Logistics Management Service of the P.A.T. using the appropriate facsimile.

The assets that may be requested are typically road wrecks, funds acquired during expropriation and not used, assets transferred by the State, etc..

Excluded from this application are all the funds registered in the Land Register as water and hydraulic property of the P.A.T. or property of the P.A.T. road branch.

On the other hand, the assets that may be alienated include the wrecks mentioned in the previous paragraph.

What to do

The application (with a €16 revenue stamp where applicable) must be signed in accordance with Article 38 of Presidential Decree 445 of 28 December 2000. The following documents must be attached to the application

- planimetry with the requested area highlighted (preferably on computer support)
- photographic documentation (preferably on computer support);
- other documentation.

The application with attachments may be sent by ordinary mail or electronically to the addresses indicated in the facsimile or presented directly at the head office of the Service or at the P.A.T. peripheral offices.

From receipt of the application, only in the case of a concession.

Once the application has been acquired, the Service acquires the necessary authorisations from the competent structures. In the event of a positive outcome, the charge is quantified and the deed prepared, which the applicant will then be asked to sign.

If negative, the applicant will receive a note of refusal.

With regard to the SALE, the offices will ascertain the availability of the property and quantify its value according to the surface area requested and an initial offer will then be formulated to be signed for preliminary acceptance by the applicant.

In the case of acceptance, the process will proceed, after acquiring the authorisation of the Provincial Council, with the payment of the price and the signing of the deed.
