Article 33 of Provincial Law No. 4 of 21 April 2016 'Provincial Law on Sport 2016' provides for the possibility of granting capital contributions for the construction, restructuring, expansion and improvement of sports facilities of a local nature, as regulated by Resolution No. 1605 of 9 September 2022, which states that the 'preliminary design document, drawn up in accordance with Article 14 of Provincial Law No. 26 of 10 September 1993' or the 'preliminary project, drawn up in accordance with Article 15 of Provincial Law No. 26 of 10 September 1993' must alternatively be attached to the application to obtain the contribution.
However, Provincial Law No. 9 of 8 August 2023 'Assestamento del bilancio di previsione della Provincia autonoma di Trento per gli esercizi finanziari 2023 - 2025' repealed both the above-mentioned provisions of Provincial Law No. 26 of 10 September 1993, as referred to in Article 91 of Provincial Council Resolution No. 1605/2022, as well as Annexes A and D annexed to the Decree of the President of the Province of 11 May 2012, no. 9 - 84/Leg, which respectively illustrated the "Elaborati facenti parte integrante del documento preliminare di progettazione" and the "Elaborati facenti parte integrante del progetto preliminare".
It follows that, on the basis of the amendments made by Article 37 of the aforementioned Provincial Law no. 9/2023, the design levels currently envisaged by Article 17 of Provincial Law no. 26 of 10 September 1993 "Rules on public works of provincial interest and for transparency in tenders" are solely the technical-economic feasibility project and the executive project.
The suspension of the deadlines for submitting new applications - which should have opened between 1 and 29 February 2024 - is therefore dictated by the need to assess the possibility of updating the implementation criteria of the Provincial Law on Sport to the level of design required by the current Article 17 of Provincial Law no. 26/1993. At the same time the need to resolve the problem, which has arisen as a result of the dynamics of the market prices of building materials, concerning the economic dimension of the projects presented in relation to the expenditure limit defined by Article 93 of Provincial Council Resolution no. 1605/2022.
Any applications for contributions submitted during the suspension period will not be accepted and will be archived.
